19 Privacy and data protection

This clause will only apply to personal information we collect, use and disclose about individuals. It does not apply to information collected, used and disclosed about corporations.

19.1 Collection of personal information

We may collect personal information from you in relation to your use of Mackay Airport for the purposes of the administration and operation of Mackay Airport. Other purposes for which your personal information may be used and disclosed by us includes enforcement, research by us or authorised third parties, statistical analysis by us and marketing of Mackay Airport or other services offered by us to tenants, occupiers and users of Mackay Airport.

19.2 Your consent

By applying for use of Aviation Services, you consent to us using and disclosing your personal information for these purposes set out in clause 19.1but the information disclosed will be contained as part of general information and will therefore not be identifiable as your information unless agreed to by you.

19.3 Our obligations

Your personal information is important to us and we will:

• (a) comply with the provisions of the Privacy Act 1988 (Cth); and
• (b) take all reasonable steps to ensure that your personal information is protected from unauthorised use and disclosure.

19.4 Other issues relating to your personal information

Your personal information:

• (a) is collected pursuant to the Transport Infrastructure Act 1994 the Trade Practices Act 1974 (Cth), the Prices Surveillance Act and any other applicable laws or regulations relating to the operation of Mackay Airport; and
• (b) will not be disclosed to any person unless you have consented in these standard conditions or elsewhere, an exception to non-disclosure applies, disclosure is authorised or required by law or if clause 19.6 applies; and
• (c) is able to be accessed by you upon reasonable notice to us and upon the payment of our reasonable expenses relating to your access (eg photocopying charges). No application fee for access will be charged.

19.5 Consequences of failure to supply your personal information

If you fail to provide to us with any personal information required by us, or you provide incomplete information, subject to any applicable law, we will send you a notice requesting the information.

19.6 Disclosure by us

We may disclose your personal information:

• (a) if that is required by law (including the Transport Infrastructure Act 1994 and the Privacy Act 1988 (Cth)) or as required by any lawful authority (eg police force or a Court); and
• (b) for the purposes of us obtaining legal or other professional advice; and
• (c) to a third party for their use in the case of a sale, transfer or assignment of the whole, or part, of our business or undertaking or the whole or part of Mackay Airport assets and facilities
