3: Your use of Mackay Airport

3.1 What you must comply with

Subject to clause 3.2, you agree to:

  • (a) use reasonable endeavours to comply with the Mackay Aerodrome Manual (sections that may require compliance by you are available from us on request). It is your responsibility to check with us regularly to find out if we have changed the manual. For Major Users, we will notify you, and consult with you, about any material changes to the Mackay Aerodrome Manual that impact on your operations and agree those changes in accordance with the principles set out in clause 1.9; and
  • (b) comply with the Mackay Airport Security TSP (Transport Security Program) and emergency procedures through the Mackay Airport Emergency AEP (Airport Emergency Plan); and
  • (c) comply with our reasonable insurance policy requirements set out in clause 8; and
  • (d) comply with all applicable laws and regulations; and
  • (e) comply with any restrictions on flying operations that may be in place from time to time by the relevant statutory authority; and
  • (f) comply with reasonable safety and security directions notified by us from time to time and necessary for the day to day operation of Mackay Airport, and if reasonably possible, we must consult with Major Users and try and give at least 7 days notice of any such directions; and
  • (g) comply with Civil Aviation Safety Authority and Airservices Australia rules and regulations; and
  • (h) comply with the requirement of the Mackay Airport AVCM (Airside Vehicle Control Manual) to obtain and observe the relevant operator licences issued by us which include, but are not limited to, AUA (Authority to Use Airside), ADA (Authority to Drive Airside), and also ASIC (Aviation Security Identification Card) under the Aviation Transport Security Act 2004 and the Aviation Transport Security Regulations 2005; and
  • (i) comply with any legally binding directions on security issued by the Department or any other law enforcement authority; and
  • (j) use reasonable endeavours to comply with any noise management procedures or regulations in place from time to time by the relevant statutory authority; and
  • (k) comply with the applicable environmental laws or regulations.; and
  • (l) comply with Workplace Health and Safety laws or regulations in place from time to time; and
  • (m) any other Conditions of Use relating to access as determined under clause 1.11.

3.2 We will provide certain information

On your reasonable request we will inform you of:

  • (a) Mackay Airport Security Program; and
  • (b) Mackay Airport Emergency Plan and emergency procedures; and
  • (c) Mackay Airport insurance policy requirements

However, we need not give you information if that would breach a confidentiality obligation we have, a law or appropriate security restrictions. If we give you this information and ask that you keep it on a secure basis and only disclose it to authorised personnel, you must comply with our request. You must keep us up to date with your contact details so that we can update you from time to time on any changes we make to this information.

3.3 Use of Common User facilities

If, at the Start Date, you have already entered into a Licence Agreement with us for the Mackay Airport Terminal facilities, those terms and conditions continue to apply until the expiration or earlier termination of the Licence Agreement.

Otherwise, for the Mackay Airport Terminal, you may only use our passenger processing facilities on the terms of our Common User Conditions for the Mackay Airport Terminal set out in Schedule 2 and these standard conditions.

3.4 Ground handling

All Ground Handling Services (as defined in the Ground Handling Conditions) undertaken at Mackay Airport must comply with the terms of our Ground Handling Conditions for the Mackay Airport Terminal set out in Schedule 3 and these standard conditions. MPA may undertake independent audits to ensure that the Ground Handling Conditions are being followed. We will provide you with a copy of the outcomes of these audits.
