Mackay Airport Conditions of Use

5 Parking and aircraft removal

5.1 Movement and removal of aircraft

Subject to air traffic clearances and any emergencies (as reasonably determined by us), on reasonable prior notice you agree to use all reasonable endeavours to:

• (a) move a parked aircraft to another position in Mackay Airport; or
• (b) remove a parked aircraft from Mackay Airport, within any reasonable time specified by us.

5.2 Failure to comply

If you do not comply with a request under clause 5.1 then we may move or remove the aircraft at your cost. In doing so we will:

• a) comply with the Transport Infrastructure (Airport Management) Regulation 1994: or
• b) notify you of:
• • i. the date and time of the move or removal; and
  • ii. where the aircraft has been, or is to be, moved to; and
  • iii. the means used, or to be used, to move the aircraft; and
  • iv. any conditions that will apply to your recovery of the aircraft.

We must make reasonable efforts to notify you a reasonable period before moving an aircraft. If we cannot do so we will notify you as soon as possible after the aircraft has been moved.

5.3 Liability for removal of aircraft

We are not liable for any loss or damage you suffer, including:

• a) losses or damage to your aircraft; and
• b) claims against you by third parties,

directly or indirectly caused by us in moving or removing your aircraft unless caused by our negligence or the negligence of our officers, employees, agents or contractors.
