Mackay Airport Conditions of Use

8 Insurance

8.1 Your insurances

You must in connection with your use of Mackay Airport, maintain with insurers in your name and, if required by us or any other person with an insurable interest for their respective rights and interests:

• a) public liability insurance for at least $20 million or such higher level of insurance cover that a prudent airline or aircraft operator would ordinarily take out (as reasonably varied by us from time to time); and
• b) other insurances which are required by law in connection with your use of Mackay Airport and a prudent airline or aircraft operator would ordinarily take out.

8.2 Additional obligations

You must:

• a) give us reasonable evidence that you have complied with clause 8.1 before the Start Date, before the beginning of each period of insurance and whenever we ask you for it (acting reasonably); and
• b) notify us as soon as practicable if an insurance policy required by clause 8.1 is cancelled or an event occurs which may allow a claim or affect rights under an insurance policy in connection with your use of Mackay Airport.

8.3 Our insurances

We maintain an Airport Operator's liability insurance policy.

8.4 Claims on insurances

You may not enforce, conduct, settle or compromise claims under any insurance policy required by these standard conditions, even if that policy also covers other property, if the claim relates to your use of Mackay Airport and provided we do not prejudice the conduct or settlement of any claim.

8.5 Acts affecting insurances

You must not do anything which may adversely affect rights under any insurance or which may increase an insurance premium payable in connection with your use of Mackay Airport, provided that, if you:

• (a) first obtain our consent (which consent shall not be unreasonably withheld); and
• (b) do not prejudice the insurance in any respect; and
• (c) pay any additional premium,

that may bring about an increase in an insurance premium payable in connection with your use of Mackay Airport.

8.6 Noting interests on insurance policies

The insurance policies under this clause must note our interests in respect of your use of Mackay Airport.
