Mackay Seaport - Notices

With the withdrawal of the previous Transport Infrastructure (Ports) Regulations 1994, and the commencement of the Transport Infrastructure and Other Legislation Amendment Act 2005, Port Authorities may control activities in ports by port notices (Part 3B, Division 1, Clause 282 of the Act). To have effect a port notice must first be advertised on at least 2 occasions in a newspaper circulated in the area to which the port notice relates, and then be displayed at or near the thing to which it relates or be published on the port authority's website in the internet.

The following presents those port notices that have been established for the Port of Mackay as above.

Towage Services

Operation of a tug service is a 'controlled activity' (Section 289 Transport Infrastructure Act 1994)

As a controlled activity, the operation of a tug service and/or associated emergency towage within the port limits of the Port of Mackay is hereby proclaimed to be regulated by Mackay Ports Limited. (Section 282 Transport Infrastructure Act 1994)

The area enclosed by the port limits is amended by regulation from time to time, and the current port limits plan is published on the MSQ website.

Accordingly, all the provisions of Part 4A of the Transport Infrastructure Act 1994 apply, which include interalia that a person must first apply to Mackay Ports Limited for written approval to conduct a tug service and/or associated emergency towage with the port limits of the Port of Mackay.

Maximum penalty for contravention of the above requirement - 100 penalty units.
